Torts Ordinance – Section 41A of the Ordinance

Unlike the rule used in law, where the one who causes the harm bears the brunt of the evidence, in the case of damage caused by a dog, the legislator chose to impose strict liability, and in such a case, the owner of the dog, or the person who keeps it, must compensate the injured party.

Their obligation to compensate the injured party is as stated, however, the owner or keeper of the dog can claim one of the defenses set forth in Section 41B, and if they prove that the defense exists in their case, they will not be obligated to pay compensation to the injured party.
